Terms and Conditions

1. Acceptance of Terms

These Terms and Conditions constitute a legally binding contract between Soumik Host (operated by Soumik Ghosh) and any individual, company, or legal entity that accesses the Website or utilizes the Services. By registering, purchasing, or using the Website, the User irrevocably acknowledges having read, understood, and unconditionally agreed to all provisions herein. Soumik Host reserves the right to decline or cancel any account.

2. Eligibility & Account Registration

  • The User must be a minimum of 18 years of age and legally capable of forming a binding contract under Indian law.
  • The User must provide complete, accurate, and truthful registration information. Submitting false data constitutes a material breach and may result in immediate account termination.
  • Account credentials are the sole responsibility of the User. The User is fully liable for all activities conducted under their account.
  • Users must maintain a valid, active email address at all times. Critical communications are delivered exclusively to the registered email.
  • Any suspected unauthorized use must be reported immediately to support@soumikhost.in or WhatsApp +91 96356 99535.
  • If we detect suspicious registration or ordering activity, the User may be requested to complete a verification process. Failure or refusal will result in immediate account suspension and termination with zero refund eligibility.

3. Service Provision & Rights Reserved

Soumik Host agrees to provide the Services selected and paid for by the User, subject to receipt of full payment and availability of technical infrastructure. All rights not expressly granted to the User are reserved.

4. Payment, Billing & Renewal Terms

All charges are due in advance per the billing cycle selected at purchase. Services auto-renew unless cancelled prior to the renewal date. All transactions are processed in INR unless stated otherwise.

  • Accepted Payment Gateways: For Indian clients, payments are processed securely via trusted gateways (supporting UPI, Netbanking, and Cards). For International clients, we accept payments securely via supported international options.
  • Pre-Order Checking: It is the sole responsibility of the User to double-check and verify all order inputs (including domain spellings, hostnames, administrative email address, and configurations) before checkout.

All new hosting plan purchases are covered by Soumik Host's 7-Day Money-Back Guarantee. Refund eligible with a valid technical justification.

5. Service Continuity & Data Management

  • It is the sole responsibility of the User to ensure invoices are paid before their due date to maintain uninterrupted service. Unpaid services are suspended immediately on the due date.
  • Shared, Cloud, WordPress, and Reseller Hosting Accounts: If unpaid, these hosting services are permanently terminated and deleted from our servers 20 days after the due date. All data, files, and backups associated with the account will be permanently erased.
  • Virtual Private Servers (VPS) & Virtual Dedicated Servers (VDS): If unpaid, VPS and VDS services are permanently terminated and deleted 5 days after the due date / suspension.
  • Backups: While automated rolling backups are maintained on our servers for customer convenience, Soumik Host holds no liability for data loss or backup failures, and the User ultimately bears full responsibility for maintaining off-server backups.

6. Suspension & Termination by Soumik Host

Soumik Host reserves the right to immediately suspend or permanently terminate a User's account without prior notice under any of these conditions:

  • Non-payment of any fees on or before the due date.
  • Breach of any provision of these Terms, the Privacy Policy, or the Acceptable Use Policy.
  • Engagement in any activity illegal under Indian or international law.
  • Any action that threatens the security, integrity, or performance of Soumik Host's infrastructure.
  • Opening a payment dispute or chargeback on payment gateways without contacting our support team first.
  • Engagement in abusive, threatening, or rude behavior toward any member of the Soumik Host support staff.

7. Acceptable Use Policy & Suspension

The following are strictly prohibited. Violation will lead to direct account suspension and termination without prior notice, and will void any refund eligibility:

  • Hosting, distributing, or facilitating access to pornographic material, adult content, obscene content, or material inciting violence, terrorism, or discrimination.
  • Infringing upon any third-party intellectual property rights.
  • Sending spam, conducting phishing campaigns, distributing malware, or facilitating email bombing.
  • Launching or facilitating DoS/DDoS attacks or any unauthorized network intrusion.
  • Deploying cryptocurrency mining scripts, unauthorized proxy/VPN services, or TOR exit nodes.
  • Hosting gambling/betting platforms, unauthorized trading systems, banking fraud, or financial scams.

8. Intellectual Property Rights

All content, software, source code, graphics, trademarks, and proprietary materials displayed on the Website are the exclusive property of Soumik Host or its respective licensors.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS. SOUMIK HOST EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOUMIK HOST, ITS FOUNDER SOUMIK GHOSH, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES OF ANY KIND.

11. Indemnification

The User agrees to indemnify, defend, and hold harmless Soumik Host, its founder Soumik Ghosh, officers, directors, employees, contractors, agents, and assigns from any and all third-party claims, liabilities, damages, judgments, costs, and legal expenses arising from the User's use of the Services or breach of these Terms.

12. Governing Law & Dispute Resolution

These Terms shall be governed by the substantive laws of the Republic of India. Disputes shall be resolved sequentially through good-faith negotiation and civil courts within India.

15. VPS & VDS Policy

  • Unmanaged Root Access: Virtual Private Server (VPS) and Virtual Dedicated Server (VDS) plans grant the User full root/administrative access. Server configuration, security hardening, software patching, and off-server backups are the sole responsibility of the User.
  • Billing & Termination: If unpaid, VPS and VDS services are permanently terminated and all associated data is irrecoverably deleted 5 days after the due date / suspension, as detailed in Section 5 above.
  • Refund Exclusion: VPS, VDS, and domain registration/transfer orders are strictly non-refundable, as stated in our Refund Policy.
  • Fair Resource Usage: Sustained CPU, RAM, or network utilization that degrades node performance for other clients may result in throttling or suspension pending resolution with our support team.

16. Shared Hosting Resource Limits

  • Inode Capping (File Limits): Each cPanel account has a hard limit of 150,000 Inodes.
  • Cron Job Frequency: Cron entries must not run at intervals of less than 15 minutes.
  • Database Capping: Each individual MySQL database must not exceed 1 GB in size.
  • Prohibited Storage Content: Shared and Reseller hosting plans are designed strictly for website hosting. Storage of raw backups, zip archives, torrents, and video streaming files is strictly prohibited.
